A conservatorship is a court-ordered and supervised relationship where a person who is no longer able to care for themselves or manage their own affairs (the Conservatee) is placed under the care of another person (the Conservator). This relationship is established by a court order and imposes certain fiduciary duties upon the Conservator.
A conservatorship is established when the Proposed Conservator's petition is granted by the Superior Court. Here, the petitioner alleges that the person sought to be placed under conservatorship lacks the ability to manage their own affairs.
This determination is made by the court based on a "Capacity Declaration" completed by a doctor. Elderly individuals are often placed under a conservatorship as a result of advanced dementia. If your loved one lacks capacity and cannot manage their own affairs, the Court may appoint an attorney for them.
The Court-appointed attorney will advocate for your loved one and will represent their interests in the conservatorship matter. The Court-appointed attorney only represents the interests of the proposed conservatee.
